Use of the application

The contents of this application are the property of the Euro-Mediterranean Center on Climate Change Foundation (CMCC Foundation) that manages them and, at its sole discretion within the limits of the law, it reserves the right to modify, suspend or cancel the terms, conditions or contents of this application, freely and without notice.

The information provided on or via this application should not be considered as any form of consultancy. Any information is made available as part of the information activity. Consequently, the CMCC Foundation does not guarantee that the contents of this application are suitable for all purposes and/or specific uses by the users and it is not liable for any damages or loss of profits resulting from the use of the information provided by the application or derived from it by the users. The contents of this application are for general information purposes only and may not always be valid in particular cases, which the user is required to assess independently, assuming sole responsibility for his/her active conduct and failure to act.

Disclaimer on the access and use of the contents of this application

The operator ensures that this application has been designed and will be maintained, as far as possible, using every reasonable method and appropriate tool to ensure the correct and continuous operation of the application. However, even based on current knowledge and technology, the site operator cannot exclude that malfunction and/or transmission problems may sometimes occur.

Upon accessing the application, the user:

1. agrees not to claim ownership of the information contained within it and not to use it in such a way as to imply any affiliation with the CMCC Foundation partners;

2. acknowledges and agrees that the application or parts of it may be temporarily inaccessible due to malfunctions and/or connection problems, or other events beyond the control of the operator;

4. acknowledges and agrees that the operator is not responsible for the material used and/or the user’s conduct when using the application;

5. acknowledges and agrees that the operator assumes no responsibility for the transmission to the user’s electronic device of any viruses and otherwise harmful content originating from third parties.

Upon accessing the application, the user agrees:

1. not to use the application or its contents to pursue illegal aims, namely as a tool to disclose or distribute in any way the material or content intended to perform illegal activity;

2. not to use the application to interrupt, destroy or make any part or the application less efficient, nor to damage the effectiveness or functionality of the application;

3. not to use the application to transmit or introduce viruses or any other material which is derogatory, offensive, obscene or threatening or which could create discomfort, inconvenience or any kind of prejudice;

4. not to use the application to constitute a violation of the rights of any person or company (including, but not limited to, copyright laws or confidentiality rights);

5. not to use the application to transmit advertising and/or promotional materials without prior written authorization by the operator.

Third party information, products and services

Whenever the operator provides hypertext links to third party websites, such links do not represent an endorsement by the operator of any products or services provided via such websites. The use of such sites is entirely at the user’s own risk and responsibility and the operator accepts no responsibility or liability for the content, use, or validity of such websites.

The operator has not verified and does not carry out verifications of the truth, accuracy, responsibility, reliability, or completeness of any content of such websites.

Users and third parties are not permitted to create links to this application without the prior written consent of the operator. In any case, the publisher reserves the right to request the removal, at any time, of the links to this application.

Intellectual property

The operator, or the actual owner, retains all rights (including copyrights, trademarks, patents as well as any other property rights) in relation to all information provided in or via this application (including all texts and the FireAware logo).

The use of this application is purely personal and not commercial (except in the event of legally agreed partnerships).

It is, therefore, forbidden to copy, modify, upload, download, transmit, publish, or distribute the content or trademarks of this application to third parties for commercial or other purposes. The user may, purely for his/her own personal use, but never for business purposes, download texts or other information contained in this application and distribute them, provided that the source thereof is explicitly and clearly indicated. Banners and logos placed in the application may likewise be downloaded for personal use, but never for business purposes, unless where otherwise stated with a clear indication related to the content in question.

Usage Limits

The use of the services is strictly personal. They can only be used by the account holder. Any irregular activity will be legally pursued in accordance with the law and will be ascribed to the account holder or the authorized device.

Online communications

Messages sent to the operator by e-mail are not secure. The operator recommends that the user does not send any confidential information by e-mail. If the user chooses to send any messages via e-mail, he/she accepts the risk that they may be intercepted, misused and modified by third parties.

Minimum requirements for using the service

In order to be able to use the service, users must have, at their own responsibility and expense, access to the Internet either directly or through tools which allow access to the contents in the application. Moreover, users must have the necessary equipment required to connect to the Internet.

Disclaimer

Neither the operator nor any of its employees or agents shall be liable for any direct, indirect, specific, incidental, consequential, punitive or exemplary damages, including loss of profits (even if the operator has been advised of the possibility thereof) arising in any way from, including but not limited to, (I) any defects, viruses, or other malfunctions caused to any equipment and other software as a result of accessing or using this application, (II) the information provided in or via this application, (III) the interception, modification or misuse of information transmitted to the operator or to the user, (IV) the malfunctioning or inaccessibility of this application, (V) the misuse of this application, (VI) the loss of data, (VII) downloading or using any software made available through this application, or (VIII) third party claims concerning the use of this application.

It is further specified that, under no circumstances, may the operator be held responsible for any damages incurred by the user resulting from the use of the information provided.

The exclusion of liability is also related to the remuneration of the directors and employees of the operator.

Warranties. Service Level Agreement

The Euro-Mediterranean Center on Climate Change Foundation does not guarantee local, time- or quality-based access to the Internet infrastructure required for data collection and transfer and, in particular, it does not guarantee that it will be possible to carry out the operations related to the service within a specified time limit.

Amendments

The operator reserves the right to change the information provided in or via this application, including the terms of the current regulations and conditions, at any time and without prior notice.  It is advisable to periodically review the site and the current regulations and conditions to check for any changes.
